Property Division in Georgia

Georgia is known as an equitable distribution state. As such, the marital property, both real and personal, is equitably divided between the two parties in a divorce. This does not necessarily mean that the property is divided evenly. Instead, the court divides the property as it deems fair.

Each spouse keeps his or her “separate property,” which includes: 1) property brought into the marriage, 2) property that is inherited, or 3) property that was received as a gift. Otherwise, the court will put all of the marital property into a “pot” and divide it between the two parties.
